Terms & Conditions

Cairns Premium Lawn & Garden

ABN: 19 630 711 314
These Terms & Conditions apply to all lawn mowing, garden maintenance, and related services provided by Cairns Premium Lawn & Garden (“we”, “us”, “our”) to any client (“you”, “your”) in Cairns, Queensland. By booking a service with us, you agree to these terms.

1. Introductory & Founding Client Offer

1.1 Our $65 introductory rate is a promotional “Founding Client Offer” available for a limited time only. We reserve the right to withdraw or modify this promotional offer at any time without notice to prospective customers.

1.2 The introductory rate applies to your first 2 lawn services only and is available exclusively to new residential clients who sign up for an ongoing weekly, fortnightly or monthly scheduled lawn care arrangement.

1.3 Standard pricing applies from your 3rd service onwards. Final pricing estimates may vary based on lawn size, terrain and property condition, and will be confirmed with you prior to your first service. The offer is strictly limited to one redemption per property.

1.4 If you cancel or terminate your ongoing service arrangement before the completion of your first 2 scheduled services, we reserve the right to invoice you for the financial difference between the promotional introductory rate and our standard rate for any services already rendered.

2. Bookings & Scheduling

2.1 Bookings and enquiries can be initiated via phone, SMS, Facebook Messenger or our website enquiry form.

2.2 We will confirm your scheduled service window in advance. While we make every effort to arrive within the scheduled timeframe, delays may occasionally occur due to traffic, equipment maintenance or unforeseen scheduling complexities.

2.3 Ongoing scheduled maintenance plans (weekly, fortnightly or monthly) operate on a recurring cycle and will continue automatically until paused or terminated in accordance with Section 3 of these terms.

3. Cancellations, Rescheduling & Wet Season Rotations

3.1 Cancelling an Ongoing Service Plan: To fully cancel or permanently terminate a regular fortnightly or monthly ongoing scheduled service, you must provide us with a minimum of 7 days’ written notice prior to your next scheduled visit.

3.2 Rescheduling a Specific Appointment: If you need to temporarily reschedule a specific upcoming appointment within your ongoing service plan, you must provide at least 24 hours’ notice where possible. Where 24 hours’ notice is given, we will offer the next available make-up appointment for that visit at no extra charge, scheduled based on availability. Short-notice changes disrupt routing schedules and may limit our ability to fit you back into that specific service rotation.

3.3 Access-Related Fees: If our team arrives on-site and is unable to access the property due to locked gates, restricted access or unsecured pets, the service will be skipped and a call-out fee equivalent to 50% of the service estimate will apply to cover travel and scheduling losses.

3.4 Tropical Weather & Wet Season Protocol: In the event of severe weather, active tropical downpours, waterlogged terrain, or unsafe conditions, we reserve the right to dynamically adjust our schedules to ensure team safety and prevent turf damage.

  • Ongoing maintenance cycles will shift flexibly to the next available dry working day.
  • Missed service intervals caused by extended tropical weather delays will be absorbed into the next available rotation safely without financial penalty or makeup liabilities to either party.

4. Pricing & Payment

4.1 All pricing provided prior to physical site inspection is a non-binding estimate based on initial customer descriptions. Final pricing may be adjusted if the property size, terrain, grass density or site conditions differ materially from the details provided during booking.

4.2 Invoices are issued immediately following the completion of each service. All residential invoices are strictly payable within 7 days from the invoice date unless a separate commercial arrangement has been formally executed in writing.

4.3 Payment must be settled via cash or electronically via bank transfer or card payment utilising the secure payment pathways provided on your invoice.

4.4 Overdue accounts will result in an immediate administrative suspension of all future scheduled services until the outstanding balance is brought completely up to date.

4.5 We are not currently registered for GST; consequently, your invoices do not include a GST component and are billed at flat, non-taxable rates.

5. Specialised Service Discounts

5.1 We offer dedicated, discounted rates for recognised seniors, pensioners and non-profit organisations. These special rates are standalone and cannot be combined or stacked with the introductory Founding Client Offer or any other offer unless explicitly authorised by us in writing.

6. Commercial & Corporate Property Agreements

6.1 Standing corporate agreements—inclusive of body corporates, childcare centres, aged care facilities and commercial business complexes—are managed via flat monthly contract rates or fixed per-job structures as formalised at the time of quoting.

6.2 Permanent commercial service agreements may be terminated by either party by providing 30 days’ formal written notice.

6.3 Property managers and real estate agencies booking services on behalf of an active rental portfolio are invoiced per property/per job, with payment cycles adhering strictly to the pre-negotiated corporate agency terms.

7. End of Lease & Vacate and Wet Season Prep Services

7.1 End of Lease/Vacate lawn and garden restorations and Wet Season Prep services are treated as standalone, intensive one-off services. They are quoted independently of standard ongoing residential rates based on the immediate real-time condition of the site.

7.2 We strongly advise scheduling these services with maximum possible lead time to guarantee calendar booking alignment prior to your official final real estate inspection date.

8. Work Health, Safety & Asset Protections

8.1 We maintain active, comprehensive public liability insurance coverage appropriate for professional property maintenance operations.

8.2 For consumer peace of mind and structural safety compliance across commercial, educational and care facilities, our active operational staff maintain current Queensland Blue Cards (Working with Children Check) and National Police Certificates.

8.3 Our team utilises professional machinery and takes extensive operational care to avoid striking property assets, garden beds or permanent boundaries. In the rare event of accidental operational damage, you must notify us within 48 hours of service completion along with photographic evidence so we can assess, validate and remediate the matter fairly.

9. Client Obligations & Site Preparedness

To ensure a safe work environment and flawless service execution, you agree to fulfil the following site conditions prior to our scheduled arrival time:

  • Ensure safe, clear and unhindered access to all target lawn and garden perimeters.
  • Ensure all domestic pets are securely confined away from the active work areas for the duration of the visit.
  • Thoroughly clear the lawn and grounds of all surface debris, toys, ground hoses, personal valuables and pet waste.
  • Proactively advise our team of any concealed operational hazards (e.g., highly irregular ground levels, exposed or shallow utility lines, damaged boundary fencing, hidden drop-offs) before our initial machinery operation.

10. Limitation of Liability

10.1 To the maximum extent permitted under Australian law, we accept no liability for any pre-existing structural wear and tear or accidental damage caused to objects, cables or fixtures that were not explicitly disclosed to us prior to the service (including but not limited to unmarked low-profile irrigation lines, buried data cables, or unmapped low-voltage garden lighting).

10.2 Nothing within these Terms operates to exclude, restrict or modify any statutory consumer guarantee, consumer right or legal remedy legally conferred upon you under the Competition and Consumer Act 2010 (Cth) or the Australian Consumer Law framework that cannot be lawfully waived.

11. Amendments & Modifications

11.1 We reserve the right to review and update these Terms & Conditions to maintain alignment with regulatory changes or operational evolutions. The current legally enforceable version will remain published openly on our web domain. Your continued booking requests and retention of our recurring services following any adjustments constitutes formal acceptance of the revised terms.
